A Faster Path to a Fair Legal Solution

Alternative Dispute Resolution (ADR) is a faster and more efficient way to settle certain types of legal disputes, and often gives the parties involved more flexibility in determining the outcome and terms of the legal solution. Relying on the lengthy formalities of the court systems to solve certain legal issues isn’t always necessary. Because many court dockets are often booked months in advance, this can also mean inconvenient and impractical delays for the parties involved in the dispute; ADR frequently provides a faster means to a resolution. In addition, ADR can often be a more affordable way to solve a legal dispute.

ADR is available to anyone seeking a legal solution to settle matters of family law, such as separation and divorce or changes in child custody arrangements, and other civil matters, including contract and landlord-tenant issues. ADR allows both sides in a dispute to come together and clarify issues, identify common ground, discuss options that answer each side’s needs, and use compromise and cooperation to resolve the problem.

In ADR, each side has the opportunity explain his or her needs and understand better the other side’s situation. It is a cooperative process in which relationships are rebuilt, problems resolved, and future problems usually avoided. Most cases, even after filed in court, are resolved through ADR.

ADR is available to resolve your dispute anytime before a suit is filed, or after a suit is filed but before a court enters a decision. ADR may be your first step to resolve your problem, or it may be the last attempt to reach a resolution before trial. If ADR is not successful, you may still seek a litigated resolution of your dispute from the court.

  • Arbitration   
    Description: Arbitration is a process in which both sides in a dispute, and their attorneys if represented, each present their side to a neutral third-party, the arbitrator, who will decide the outcome. Each side has the opportunity to present testimony, evidence, and witnesses on their behalf, though the arbitration hearing itself is usually informal when compared to a court trial in which the rules of evidence apply. Arbitration allows for a faster resolution to a dispute than might otherwise be obtained from the courts.
  • Mediation   
    Description: Mediation is a form of Alternative Dispute Resolution or ADR which places you and the other side in control of resolving your dispute. Mediation is available in family and other matters. In mediation, both sides agree to meet with a mediator, a neutral third-party who will discuss the problem with you and facilitate a resolution on which both sides can agree. There are no “winners” and “losers” in mediation – it is a “win-win” process for both sides.
  • Collaborative Law   
    Description: Collaborative Law is a respectful and cooperative means of negotiating a settlement of all issues arising from a legal dispute.
